Client Terms and Conditions

Please read the full terms and conditions set out by The Individualist. This agreement documents the legally binding terms and conditions attached to the use of the site. By using or accessing the site in any way, booking services or adding your own content on to the site you are agreeing to be bound by these terms of service.

To book any services through The Individualist you must be a registered client on our platform. This is so that The Individualist can track bookings and ensure that our clients are getting the upmost professional customer service from our service providers.

When signing up to The Individualist you will be asked to provide the following information;

First & last name, email address, username and password.

Your username and password will be what is used to sign into your profile. You are responsible for keeping this information private and not sharing it with a third party. We recommend your password is one you have not used before and is at least 8 characters long with a mixture of upper and lowercase letters and include numbers and symbols.

Once a registered client you can book services through our website, receive invoices, make payments, have a list of favorite professionals and post reviews on service providers you have used. When booking a professional to come to you, you can also store your address and contact details so that it is to hand for the service provider.

  1. Booking:

1.1 The services you book through The Individualist are sold by our service providers. The Individualist are only responsible for arranging and concluding your booking as we have been appointed to act as a representative for our service providers services.

1.2 The contract for any service booked is between you and the service provider. We are not liable and hold no responsibility for the service you receive from our service providers. However please do make The Individualist aware if you have any problems with a service you receive from one of our service providers and we can do our best to help the situation.

1.3 If you pay for a service through our platform, your payment goes straight to the service provider’s account in which the service provide shall provide you with an invoice to your profile. In some case’s The Individualist may receive the payment on behalf of the service provider in which a invoice will be generated from The Individualist.

1.4 Please check any restrictions relating to a service before booking. If you have medical or health related issues, please ensure you disclose this information with the service provider prior to a treatment been carried out.

1.5 If you would like to cancel or reschedule an appointment made, this can be done by;

Your personal profile under bookings;

1.6 Cancellations of services before 48 hours of service may be refundable unless you have processed a none refundable deposit to a service provider. Less than 48-hour notice on a cancellation will not be refundable.

  1. Relationship between you, service providers and The Individualist:

2.1 The website is operated by The Individualist LTD, a company registered in England under the company number 11137508 whose registered office in Wakefield, UK.

2.2 The website allows you to search and book hair and beauty professionals from across the UK region. Those services are brought to you by our registered service providers and not by us. The Individualist is responsible for concluding the bookings made, not the service received. The serviced received are of the responsibility of the service providers who provides them. In the event of paying for a service, the payment will be made to the service provider or in some cases to The Individualist. If we receive the payment on behalf of a service provider, your debt to them will be paid.

  1. The legal implication of when booking services creates two binding contracts;

3.1 A contract between you and The Individualist, in which The Individualist has certain responsibilities to you regarding booking services.

3.2 A contract between you and the service provider in respect to the services you book with them. The contract is subject to a cancellation period notice which will be presented to you via their profile or upon making the booking.

3.3 All services you purchase from the website are offered by The Individualist on behalf of the service providers. Therefore, we are not liable to you for the services you book through our website. The liable party is the service provider.

3.4 We amend and update these terms from time to time, so we ask that every time you wish to make a booking you re read these terms to ensure you agree with them at that time.

  1. Services:

4.1 Our service providers are under legal duty to provide industry standard services.

4.2 Our service providers are to ensure that the information on their profile is accurate and not misleading in any way, but we cannot verify the information they provide us with. It is the service providers responsibility that all the services listed on their profile are actively available services they provide.

4.3 It is your responsibility to discuss with the service provider and medical or health related issues that may affect the service (allergic reactions, sensitivity). Failure to so do, neither The Individualist or service providers will be held liable to any loss or damages caused by a service that could have otherwise been avoided with the correct communication.

4.5 As a customer, you have legal rights in relation to any service that has been carried out without care or skill. Advice about your legal rights can be found at your local citizens advice or trading standards office. Nothing in these terms will affect your legal rights.

  1. Cancellations:

5.1 In addition to your rights as a consumer of the services brought to you by The Individualist, in certain cases of cancellations you may be entitled to a full refund. Any services cancelled before 48 hours of the service taking place will be offered an additional space or a refund. Any service cancelled less than 48 hours will be subject to the service providers cancellation and deposit terms.

5.3 The service provider has full responsibility of adding vat to their total bill where applicable. The Individualist does not charge you vat as services are provided by the service provider. Any vat added will also be added to any invoices processed by the service provider.

5.4 Payments made through our website are not done in house they are processed by a third party. We use Stripe and PayPal as our payment providers. This function should be available all the time however we cannot guarantee that the facility will be error or virus free. We will attempt to give notice of any maintenance on these facilities if it is unavailable however in unknown cases we can not promise.

5.6 Please note that if you are paying at the appointment, you are responsible for doing so. Any unattended appointments without the correct form of cancelation will mean that you still owe the service provider the appointment full amount.

5.7 We do not accept liability for any type of losses, whether it is loss on income, loss of business, loss of profits.

  1. Our rights to these booking terms:

6.1 We may change and update the terms for time to time, for the following circumstances:

6.2 Changes made to how we process payments.

6.3 If there is a change to our business that means we need to amend these.

6.4 We ask that you actively check these terms to ensure that you are still happy to proceed with any bookings.

  1. General:

7.1 Any correspondence from you must be sent by email at servicehelp@theindividualist.co.uk.

7.2 Please note our customer support hours are Monday to Friday 8am-8pm, Saturdays and Sundays 10am-1pm. Within these times we will answer your queries.

These terms and conditions have been set out in accordance to all laws of England. You and The Individualist agree that English laws will have non-exclusive jurisdiction over any claim or dispute arising from booking services via our website.
